The legal profession and LegCo are not likely to back down
publicly from their position that the Court of Final Appeal should be
given greater flexibility to invite overseas judges, while re-negotiation with China is not an option. We need to do more preparatory work and resolve a number of policy issues before
drafting of the Bill can proceed further. Discussions of the draft
Bill with the Chinese would be necessary in due course.
Line to Take
Legislation and other preparatory work are needed for establishing the Court. These are in hand but will take some time. Legislation is being prepared on the basis of the Sino-British agreement. No timetable for introducing legislation into Lego, but ́establishment of the Court before 1997 remains high on the agenda of
the Government.
