ADAPTATION OF LAWS: PAPERS 6, 7 & 8
1.
139
Thank you for your letter of 6 December detailing amendments to the consultation papers on the above subjects.
2. In relation to Paper 6, our Legal Advisers still have reservations regarding your decision not to amend the term "foreign notes" in relation to Chinese notes. However, given that you are confident of your ability to justify this to the Chinese side, we are content for you to put it to them as it stands.
3.
In relation to Paper 7, our Legal Advisers still consider that proposal (g) should include reference to section 16(2), since the new wording substituted by the Amendment Ordinance contains two references to the Governor.
4.
Thank you for enclosing the 1993 Audit (Amendment) Ordinance. We were previously unaware of its existence! There appears to be a problem with the supply of copies of the Hong Kong Gazette to our Legal Library. They have taken this up with HKG Printing Department, but for the time being I should be grateful if you could help us by drawing our attention to amending legislation of which we need to be aware when studying your adaptation papers.
5. Are the Chinese aware of all the amendments to the Ordinances which are the subject of adaptation proposals? Presumably you provide them with a complete set of the relevant legislation with each adaptation paper. Might there be a case for referring to the amending legislation in the papers which you give them, or listing it in an annex? Perhaps you already do so; if so, it would be helpful if you could copy those annexes to us.
