FACTUAL ERRORS AND INACCURACIES IN THE SUBMISSION BY THE
LAWYERS' COMMITTEE FOR HUMAN RIGHTS AND THE WOMEN'S
COMMISSION FOR REFUGEE WOMEN AND CHILDREN
The Hong Kong Government would like to take the opportunity to correct a number of factual errors and inaccuracies in the submission by the Lawyers' Committee for Human Rights and the Women's Commission for Refugee Women and Children, based on which the three cases of alleged arbitrary detention were
reported to the United Nations Working Group on Arbitrary
Detention. These are as follows:

"Hong Kong policy in which one group is punished to deter the potential acts of others who are related solely by national origin, is a term of arbitrary detention
in violation of international law."

1.1 This statement is misleading in
that the Hong Kong Government's policy on screening and detention has already been clearly explained to all Vietnamese asylum seekers individually and collectively upon their arrival in Hong Kong. They may
choose to remain in detention centres or
continue their voyage. They are therefore being detained not because of the
potential acts of others but out of public
order considerations. These include the pressure of illegal immigration from China, the immediate repatriation of large numbers of Chinese illegal immigrants on a daily basis and the increasingly adverse local perception of the apparent disparity
