The prominent Chinese dissident Wu'er Kaixi arrived in Hong Kong on 7 December from Australia with a valid double journey transit visa. He was granted a 48-hour transit stay which he now seeks to extend prior to departing for Taipei. Another prominent activist Hou Dejien has also entered Hong Kong on a transit visa and been granted a 48-hour transit stay. Neither visa application was referred to Hong Kong.

DETAIL

2. Wu'er Kaixi who possesses a Taiwanese passport arrived in Hong Kong on 7 December from Australia via Singapore on a valid double journey transit visa in a document of identity issued in Los Angeles. He requested a 48-hour stay for sightseeing purposes before intending to depart for Taipei on Thursday 9 December. We allowed him entry but obtained his assurance that he would not engage in political activities whilst in Hong Kong.

3. Subsequently Wu'er Kaixi advised that he would stay at the Peninsula Hotel and expected to meet Miss Anita Mui, a popular and controversial film actress and singer. Miss Mui was recently involved in a a fracas at a bar that led to a triad-related murder and the singer's abrupt departure for a short sojourn in Singapore.

4. On 8 December Legislative Councillor and democracy activist Lau Chin-shek asked that Wu'er Kaixi be allowed to extend his stay by a further two days. Lau indicated that if we refused, Wu'er intended to make a side trip to Macau and on the strength of his double journey visa re-enter Hong Kong to obtain a further 48-hour stay.

5. We rejected Lau's request on policy grounds we only extend transit visas in very exceptional circumstances
