1. The text of the Aide Memoire in TUR is substantially the same
that handed over to us by Aung Bwa (Counsellor) Myanmar Embassy during a meeting with AMD and DOT on 21 June. response to his questions about our views on ownership of MAI, we' explained that we still awaited the advice of FCO Legal Advisers. We were aware of MAI's plans to begin services to Hong Kong with effect from 15 August and would endeavour to complete any necessary administrative arrangements in time for this to take place. However, if legal advice was that MAI did not meet ownership and control criteria, and unless the service were to operate under a newly agreed Hong Kong/Burma ASA - when the question of ownership and control would not be an issue would need to consider how to accommodate it within the terms of Article 3 (i) of the UK/Burma ASA. It was possible that an interim arrangement could be made for MAI to operate to Hong Kong (but not to the UK if they subsequently decided to) until such time as agreement was reached with Hong Kong. This could be only a temporary measure however, and the onus would be on the Burmese and Hong Kong authorities to conclude an agreement quickly.

Legal Advisers views have now been received and we will be discussing them with DoT as soon as possible (the relevant people We will are currently out of the country on an ASA negotiation). Let you have a definitive answer soon, but in the meantime would suggest that you take any suitable opportunities to impress on the Burmese the advantages of concluding an ASA with Hong Kong as quickly as they can.
