GREEMENT. TRONG KONG ROUTES

1. You will have seen from Hong Kong telno 195 that agreement was reached recently between

between Hong

Hong Kong and South African delegations on a new package of rights to be operated by the airlines of each side under the 1992 UK/South Africa ASA.

On the basis of that, both delegations undertook to recommend that the ASA be amended by an Exchange of Notes disapplying the provisions of the 1945 ASA from air services between Hong Kong and South Africa, as envisaged in Article 18 of the 1992 ASA, and adding a Hong Kong route to each section of the Route Schedule accordingly. (Please refer to paragraph 3 of the enclosed UK/South Africa CMU of 5 February.)

The way is finally clear therefore for an Exchange of Notes to take place between the UK and South Africa to effect these amendments. I should be grateful if you would pass a copy of the enclosed draft to the South African authorities for their consideration.

There are two minor additional adjustments to the wording of the draft Schedule annexed to the Note that you should bring to the attention of the South Africans. These changes have not come up in previous discussion as they are simply consequences of the appearance of the Hong Kong routes next to those of the UK in the Schedule. They are as follows:

(a) a comparison of Note 3 to Route I with Note 3 to Route II in each section reveals that the former contains the additional provision "This restriction also applies to all forms of stop-over traffic". Normally Hong Kong Route Schedules (on which the draft for Route II was based) do not contain such a provision because the Hong Kong Government considers it self-evident that "traffic"
