YOUR TELNO 1755 AND FCO TELNO 968: BA/DAS AIR CARGO SERVICES TO HONG KONG

Your Telno 1755 was very helpful in clarifying the position with regard to these services. There has been some confusion here too over the application for the above service. We can now confirm that DoT granted an application by DAS (not British Airways as stated in our Telno 968) to operate in its own right on the UK/HK cabotage sector following receipt of no objections from UK airlines. Having looked further at the operation in light of your telegram and further details from the airlines, it is now clear that the DAS operation would not qualify for a UK permit. In any case an operation by DAS would not, of course, fall within the UK/HK scheduled arrangements. We note that you are unable to grant the application by DAS.

We note that Hong Kong are prepared to issue a permit to BA to operate within the UK/HK arrangements. However, the UK cannot permit BA to use foreign registered aircraft unless the arrangements comply with the EC Licensing regulation. From the information DoT has, the service involving DAS aircraft would not appear to meet these criteria. BA have been informed of these points.

3. DoT apologise for adding to the confusion in Hong Kong. It is clear that a better understanding of the procedures is needed by airlines and DoT will be looking to see what can be done in this regard.
