1. We were not previously aware of this case. On the basis of telephone contacts with Hong Kong this evening we understand that there has already been considerable activity on this, and the Indian Commission has been in close contact with HKG. Both we and (subject to Hong Kong's views) HKG are aware of the importance the Indians attach to this and are sympathetic to their request. But the degree to which we are able to help is constrained by the provisions of Hong Kong law and immigration regulations.
2. For Hong Kong : Grateful if you would let New Delhi (and us) have a full account of developments so far, covering what we understand was an attempt to repatriate the suspects to India, what action you now intend to take, including whether it will be possible to arrange for Indian policemen to accompany the suspects on the flight eventually chosen, and the Legal background to the case. to repatriate the suspects to India, and that you have offered to arrange for Indian policemen to accompany them on the flight to Bangkok. Please brief New Delhi urgently on these, as well as the legal situation.
3. For New Delhi : In the Light of Hong Kong's advice, please explain to the Indians the actions already taken and the legal situation. Please reassure them that HKG will do all it can to help, and pass on any suggestions Hong Kong may have. Granted the lack of time, it would be best for the Indian Commission to continue to Liaise with HKG to find a solution.
