Problem

1.

Hong Kong are close to agreement with the Guangdong authorities

Government on the land border and on the sea boundaries and the

boundaries in the two bays. How should any agreement be reflected and implemented? Hong Kong have suggested that it be reflected in an MOU between the two sides and implemented administratively.

Recommendation

2.

That should suggest to Hong Kong that they reconsider the option of Changing the Legal Boundary of Hong Kong to make it coincide with any boundary that is agreed. Legal Advisers agree. I submit a telegram.

Background and Argument

3. After several years of negotiations the Hong Kong Government

seems to be close to reaching an agreement with the Guangdong

Government over the Boundaries of Hong Kong. (The Chinese have

refused to permit this subject to be discussed in the JLG,

arguing that the boundaries of the SAR are a matter for them

alone. They have permitted discussion with the Guangdong
