This came in Ms Barrett's absence. I understand that the meeting to be held on 18 October has in fact been cancelled. It is unclear to me whether an Order in Council under the Hong Kong Act 1985 would be necessary. From what you kindly read to me over the telephone, it sounds as if there ought not to be any such need. I did wonder whether the proposed legislation would have extraterritorial effect but this seems unlikely. I also take it that no international agreement is involved; for example, the legislation is not required in order to enable the Hong Kong Government to give effect to a treaty which will be *applied to it. May I suggest that you ask the Hong Kong Government for a copy of the draft legislation and Crown Solicitor's advice; when you have them, please pass them to Ms Barrett for her comments.
