COPYRIGHT, DESIGNS AND PATENTS ACT 1988: EXTENSION TO DEPENDENT TERRITORIES
I would be grateful if you would forward this letter to the relevant people in all the UK colonies so that each one can decide whether to request the United Kingdom Government to extend the copyright provisions contained in Part I of the Copyright, Designs and Patents Act 1988 to that colony. (The remaining parts of the 1988 Act, apart from a few miscellaneous provisions in Part VII, are not concerned with copyright law.)
Part I of the Copyright, Designs and Patents Act 1988 came into force in the UK on 1 August 1989 when it replaced the Copyright Act of 1956. The 1988 Act restated and reformed the whole of copyright law and I can provide more information on any particular aspects of this to anyone who is interested. As with earlier Copyright Acts in the UK, the 1988 Act contains a provision whereby Her Majesty may by Order in Council extend the provisions of Part I of the Act to any colony (section 157). It is possible for the extension to be subject to exceptions and modifications if appropriate, and for the provisions of Part I when extended to another country to be modified in that country in certain circumstances.
The United Kingdom Government would not wish to extend Part I of the 1988 Act to any colony unless it had received a specific request. It would therefore be extremely helpful if all the United Kingdom colonies could inform us of their wishes in this respect:
