Explanatory memorandum

This Ordinance enacts by repetition and modification by way of daptation the provisions of the Cable and Broadcasting Act 1984 of

:he United Kingdom that amended the Copyright Act 1956 to provide

for copyright protection to cable television as part of the Hong

Kong law.

2.

Section 4 of the Copyright Ordinance is repealed and replaced

by the insertion of section 40(3) and (3A) in the Copyright Act.

Schedule 2 is added to the Copyright Ordinance.

This

incorporates with minor adaptive modifications into the Hong Kong

Copyright Ordinance the provisions of the Cable and Broadcasting Act

1984 (U.K.). The principal modifications relate to removing

references to United Kingdom authorities and instrumentalities.

4. The Schedule, inserted by clause 4, makes consequential

amendments to the Copyright ordinance on the introduction of a

Schedule 2 to that Ordinance.

5. The following comparative table sets out the amendments in

Schedule 2 compared with the amendments in sections 22, 23 and 24

of, and paragraph 6 of Schedule 5 to, the Cable and Broadcasting Act

1984 U.K. (1984, c. 46)
