Dear Mr Ricketts,

Amendment to the Schedule to the Trade Marks Ordinance

Section 13A of the Trade Marks Ordinance, Chapter 43 of the Laws of Hong Kong (copy at Appendix A), deals with priority for applications made in countries which are contracting parties to the Paris Convention for the Protection of Industrial Property

1883.

These countries, excluding the United Kingdom, are listed in the Schedule to the Ordinance (copy at Appendix B). The Schedule is revised from time to time to reflect changes in the list of contracting parties as published by the World Intellectual Property Organization (WIPO) which administers the Convention. It was last revised in

1991.

Since 1991, there have been a number of changes to the list of contracting parties due to the accession of new countries, in particular those which were members of the former USSR. The most recent WIPO list (copy at Appendix C) contains countries which we would like to add to the Schedule with consequential deletions.

On the advice of the Attorney General's Chambers, we would like to

propose the following additions

(a) Chile, Gambia and Swaziland
