SUBSCRIPTION TELEVISION COPYRIGHT PROTECTION
1. Following a conversation with Graham Jenkins, I enclose a copy of Hong Kong telno 1013 concerning the need for a stopgap measure which would provide copyright protection for cable television programmes due to come on stream in October.
2. Hong Kong envisage that all of the provisions of the Cable and Broadcasting Act 1984 should be extended to Hong Kong. Presumably this would require an order in Council, which in turn would need to be laid before the Privy Council. With the Parliamentary recess approaching, and copyright protection required from October, we may need to move quickly.
3. If you agree, I should be very grateful if you could urgently put in hand drafting of an Order in Council. If this raises any difficulties, you may wish to ask your Legal Adviser to have a word with ours, who is aware of the subject and who in any case would wish to have an opportunity to comment on the draft Order.
4.
Hong Kong have raised additional questions in paragraphs 9 and 10 on which I would be grateful for your advice.
