As indicated above, subject to the modification in respect of Article 9, the requirements of the convention are met by the provisions of the Employees' Compensation Ordinance and subsidiary legislation made thereunder and relevant administrative arrangements. Notification of accidents at work is statutorily required from employers. The police, hospitals, newspapers, the employees themselves, their friends and relatives also assist in bringing accidents to the notice of responsible authority. Employers are required to pay periodical payments to an injured employee whose injury is of a temporary nature, and an additional lump sum if permanent incapacity results from the accident. Where death arises out of an occupational injury, bona fide dependants of deceased employees are entitled to compensation, also payable by the employer. Medical aid is available at government and other hospitals as well as clinics at nominal charges, which are reimbursable by the employer. The degree of incapacity is assessed by a two-tier system of Employees' Compensation Assessment Boards appointed by the Commissioner for Labour, which provides fair and formal methods of assessing claims involving the likelihood of permanent incapacity.
The aim of the administering authority is to secure the observance of the provisions of the ordinance (i) by agreement between an injured employee and his employer, which had to be approved by the Commissioner for Labour, and (ii) by certificate of compensation assessment issued to the employer and the employee by the Commissioner for Labour in respect of minor injuries involving no permanent incapacity or
