DEPENDENT TERRITORIES AND THE MONTREAL PROTOCOL

We have spoken on the above on a number of occasions. I attach a summary of the agreements reached at the Fourth Meeting of the Parties. You are to send it to DTS together with a copy of the meeting report which you already have.

We have also spoken about the 'essential uses' provisions. As you are aware, under the Montreal Protocol continued production for a limited number of essential uses is to be allowed after phase out. For halons this is after 1 January 1994,

1 January 1994, for all CFCs, carbon tetrachloride and 1,1,1 trichloroethane this is after 1 January 1996. A procedure and criteria for agreeing such uses was adopted in Copenhagen under Decision IV/25. We have recently confirmed with the Protocol Secretariat the date by which nominations have to be made in time for consideration by the process. For halons it is 31 March 1993, for the other substances it is 30 September 1993.

While we would not expect DTS to have any uses for these substances which were different from those in the UK, we must be sure. I therefore attach paragraphs for inclusion in the telegram covering the summary and meeting report. It refers DTS to the text of Decision IV/25, but gives my name as an enquiry point. Because of the tight timetable I have asked for any halon uses to come directly to me, the others I have suggested should go via ESED. Are you content with this approach? Those DTS who have neither ratified the London Amendment nor submitted the relevant data are not eligible to submit nominations for 'other fully halogenated CFCs', carbon tetrachloride or 1,1,1 trichloroethane.

I have also included a paragraph reminding all DTS who have ratified the 1987 Protocol that they are required to submit data to you on a six monthly basis.
