Thank you for your letter of 4 March reporting on the soundings you took with DGXI. I have circulated your letter to interested FCO and Whitehall departments; the following incorporates their comments.

The wording the Commission now propose to use in the trade provisions of the Regulation appears to meet our concern that there should be no difference in wording between the Protocol and the Regulation. But we agree that we cannot give any definitive view until we see the text. No doubt you will forward a copy as soon as it is available.

3. As far as the forum in which we should pursue seeking an understanding about the application of Article 4 of the Protocol and articles 5-9 of 594/91 when applied to Taiwan, the proposals in your para 4 look sensible. However, as we have no direct experience of the various committees in Brussels; Ian MacLeod will be better placed to comment. But wherever the discussion takes place, we will need to ensure that there is a formal written record of the agreement.
