MONTREAL PROTOCOL ON SUBSTANCES THAT DEPLETE THE OZONE LAYER

Thank you for your letter of 1 July enclosing a complete set of the legislation enacted to implement the Montreal Protocol and London Amendment.
2. As you now have legislation in place to implement the London Amendment to the Protocol, arrangements will be set in hand to have UK's ratification of this Amendment extended to Hong Kong once you have been able to clarify the points raised in my letter of 5 August. Confirmation of the deposit of the Instrument of Ratification with the Depository in New York will be forwarded to you in due course.
3. As you may be aware, UK has yet to ratify the Copenhagen Amendment but we note that you intend to have it extended to Hong Kong at a later date. Once you are able to confirm that you have appropriate legislation in place, and have obtained the agreement of the Chinese authorities, we will be able to take the necessary administrative action.

There appears to have been some misunderstanding over essential uses. Nominations for continued production for 1994 for halon 'essential uses' had to be with the Ozone Secretariat by 15 May 1993. We did not receive any nominations from Hong Kong, although Ms Godfrey (Global Atmosphere Division, DOE) discussed the use of halons on underground railways with one of your colleagues, Franklin Chung, earlier this year. The nominations submitted by the UK did not cover Hong Kong.

The Halon Technical Options Committee met in Toronto in early July to assess the nominations received. They decided to recommend to the Technology and Economics Assessment Panel (TEAP) that no production would be needed in 1994 as there is sufficient halon already available to cover the nominations received. The TEAP met in Toronto in the week beginning 12 July and endorsed this decision. We understand this recommendation will be made to the Parties for consideration at their meeting in Bangkok in November this year.
