If Mr Hurd's China mission is only to reiterate 1. Britain's stance on the through train and 2. that the electoral arrangements for HK must be "fair, open and acceptable to HK people", China will certainly reject Britain's demands, thereby casting shadows on the talks.
It is impossible for the Chinese side to guarantee that all legislators elected in 1995 will ride the through train in 1997 as people and circumstances may have changed by that time. Besides, the through train is China's internal matter. It should be left to the SARPC to decide. It is inappropriate to set concrete standards at the moment.

The through train cannot be interpreted simply by way of Article 104 of the BL. Annex II to the BL clearly stipulate that for a Legco member to ride the through train, he must uphold the BL, pledge allegiance to the SAR, meet the relevant BL requirements and be confirmed by the SARPC.
If the formation and composition of the Legislative Assembly do not conform with BL stipulations, legislators cannot ride the through train even if they uphold the BL.
The Chinese side has no objection to the British suggestion that certain guidelines for the legislators to board the through train should now be set. However, these guidelines must ultimately be confirmed by the SARPC.

Although Article 104 of the BL states that senior civil servants, councillors or judicial personnel have to take an oath before holding public office, it does not follow that anyone taking an oath can become an SAR legislator.
The through train issue must be dealt with in accordance with the relevant BL stipulations and the appointment of legislators must be confirmed by the SARPC.
