Since the Opinion of Counsel was received I have spoken again to Mr Lawton in the Treasury Solicitor's Office about whether there would be any difficulty in bringing the ICR portion back to the UK whilst leaving the British Council's portion in Hong Kong for as long as possible, where it is most effective. He said that in this case we may need two Sign Manual directions rather than one (I gather this in itself would not be a problem) but that we should first work out the terms under which the ICR should receive their portion of the funds. The recommendation of the Law Officers to use the original draft letter of intent would seem appropriate here. Again, we shall have to agree terms with

the ICR.

I would be grateful for your views on the above and any further suggestions you might have. If you are content that we should proceed in this manner I will send you a draft submission for clearance in due course. Attached are copies of the original British Council draft Declaration, the draft letter of intent to ICR and the Opinion of Counsel from the Law Officers. Please let me know if you need to see any further background papers.
