MR GOODLAD'S MEETING WITH MR HOWARD YOUNG FOR DRINKS AT LORD

1.

I submit a short background briefing note for this meeting.

2. Mr Young represents the Tourism Functional Constituency in LegCo. He is a member of Mr Allen Lee's Liberal Party, and has

good contacts with the Chinese.

3.

In addition to a general talk about where we stand in our negotiations with China on election arrangements, it is possible that Mr Young might raise the case of two Hong Kong prisoners currently held in Manila. Mr Goodlad might like to be reminded

of the background to this.

4. Au Wing Cheung and Wong Cheun Ming, two Hong Kong citizens, have been held in prison in Manila since 7 September 1991 when they were arrested at the airport for possession of drugs. They

were subsequently sentenced to life imprisonment on 29 November 1991. They filed an application for judicial review but while

this was in progress, the courthouse caught fire (on 18 January

1992) and all the records were destroyed. The review finally

took place on 24 March 1993 but no decision has yet been taken. Our Embassy in Manila, as well as lawyers acting on behalf of

Mr Au and Mr Wong, have been following up the matter.

5. Mr Young has raised these cases with Mr Goodlad on several

occasions, the last time being on 31 May. Mr Young is fully

convinced that the two are innocent victims in a drug smuggling

scam operated by other (Malay national) members of the tour group Au Wing Cheung was leading, and is concerned at the lack

of progress in the judicial review of these cases. Mr Goodlad

wrote to the Philippine Ambassador in London on 23 June to

express the concern of the British Government and raised the matter during this visit to the Philippines on 10 August with the Philippine Solicitor General. So far there has been no

response.
