The proposed amendment to CR66 is acceptable.

The 1977 amendment to CR57 (3) to which you refer in your minute is incorporated in the typed text of the latest version of the Colonial Regulations which I have; I attach a copy for you. The wording is the same as that which you have quoted in your minute.

I am unaware of any past amendments, but as you may or may not know, it is possible that the regulations may be amended for Hong Kong to take account of changes in localisation policy. This may or may not be decided by July. I suggest you have a word with Mr Ricketts about this and in particular whether the July date may need to be put back if it is decided to go down this route.

4. Colonial Regulations are "directions to Governors for general guidance given by the Crown through the Secretary of State for Foreign and Commonwealth Affairs". (They apply generally not just to Hong Kong, although Hong Kong has its own Appendix as well (Appendix II)). Accordingly, the Foreign Secretary should probably approve any text of any regulations before they are printed. He must, of course, approve the policies which they reflect. You could check whether he approved the text of the amendment to CR57 (3). I also suggest you ask Mr Herdman, WIAD (back on 7 June) what the normal practice is: would the Secretary of State approve the wording of regulations before printing. If so, he would also need to approve the wording of CR66 and any other amendments eg on localisation made between now and printing. If his approval is required, this could be done in the context of a submission about reprinting the Colonial Regulations. I suggest you ask Mr Herdman if he plans to do such a submission.
