GOVERNOR OF HONG KONG: DECLARATION OF INTEREST

We spoke. There would appear to be nothing in the Colonial Regulations (my out of date copy) or the Letters Patent or Royal Instructions which would prevent Mr Patten from completing this form. The form is headed "Register of Members" Interests" and refers throughout to Members (of Exco). The Governor is, of course, President of Exco, (RI VIII(1)) (telno 249 of 17 February from Hong Kong also focussed on this). It is therefore somewhat inappropriate for the Governor to sign it, especially as the purpose of declaring an interest is to ensure that a member of Exco tender impartial advice to the Governor. I would recommend that Mr Patten did not sign it but I cannot see any legal problems which might result if he were to do so (unless if he were to make a false declaration!). Ultimately this involves a policy decision.
