40 EC members. Second, there will be a group of FC electors who, although eligible to register in the new FCs, will have chosen to remain in the existing FCs (e.g. lawyers, company directors). Under this alternative, these FC electors will not be able to vote for the EC members.

Option (d): an EC based on occupational groups and District Board membership

This option is to form an EC based on “occupational groups” (which is an internationally recognized census method of classifying the economically active population) and District Board membership. It provides probably the broadest limit to which the model set out in paragraph 2 of Annex I of the Basic Law can be stretched to make the EC as representative of the community as possible. Details are described at Annex E.

is within the five principles on an EC agreed between the British and Chinese governments in February 1990, and is consistent with our [alleged] "agreement in principle” with the Chinese proposal at the time that the composition and ratio of the EC should follow that specified in paragraph 2 of Annex I to the Basic Law;

is not what the Chinese would regard as consistent with the Basic Law, in that the first three sectors of EC membership are to be elected by Hong Kong's 2.7 million working population, rather than by corporate bodies or organizations; and

involves complicated electoral arrangements, although probably not much more difficult than those associated with our proposed nine new functional constituencies (See Annex B). Those complications and difficulties would, however, be compounded if our proposed nine new FCs are to be retained in their present form: this would mean holding two sets of elections for the same 2.7 million working population but registered under different constituencies. This option is thus only practicable if our proposals for nine new FCs are to be replaced by FCs more on the line of the existing 21 FC seats.
