Option (a): EC based on existing FCs and DB membership

Annex I of the Basic Law provides for an 800-member EC for the second SAR legislature (1999). This EC is to be made up of four major sectors, the details of which are at Annex A.

The first EC in 1995 could likewise comprise four broadly similar sectors. Three of the sectors (viz. "Industrial, commercial and finance", "The professions", and "Labour, education, health care and social services”) can be delineated on the basis of the existing FCs. Each sub-sector (Made up of an FC e.g. the Legal FC as a sub-sector of "The Professional" sector) will elect a number of EC members. All registered electors in the relevant FCs will be eligible to elect the EC members. It is for consideration whether candidature for these should be restricted to registered FC electors, or should be opened wider. As the electorate of the nine new FCs proposed in the current package (see Annex B) is constituted on a basis different from that for the existing FCs, they have been omitted from the franchise of an EC formed under this option.

As for the fourth sector (1)", one possibility is for it to include directly elected DB members only (see also paragraph 11). However, since each sector is to elect 200 members to the EC, it is for consideration whether the 338 DB members should elect 200 EC members amongst themselves (or 140 if Members of the Legislative Council (LegCo) were to be members of the EC). An alternative is to give each of the DB members a seat on the

lace?..
