MR FREDERICK FUNG AND 4 ADPL COLLEAGUES, 18 MAY

1 Mr Fung and colleagues were given a good innings yesterday by Mr Goodlad in the morning and the Secretary of State in the afternoon. They covered the same rather detailed ground on both occasions and handed over a substantial document setting out their proposals on electoral issues, human rights (which in their view includes BN (0) passports), and the airport.

They spelled out their concerns in 4 main areas:

Talks with China on electoral arrangements

Mr Fung pressed hard for transparency (Hong Kong people to be kept fully informed, no quote secret deals unquote) and consultation. He suggested various cumbersome consultation processes eg a quote scientific survey unquote of Hong Kong opinion and some sort of joint consultation machinery organised by Britain and China together. He was reminded of the various ways we and the Governor had tried to sound out and take on board public opinion and of our firm undertaking that any agreement must be acceptable to Hong Kong people. He was told there could be no question of secret deals since any agreement reached would have to be debated and passed into legislation by LegCo.

BN (0) Registration

The main thrust of the ADPL's somewhat emotional argument was that BDTCs have a right to register as BN (0)s up to 30 June 1997. It was therefore a denial of an existing right to impose legally enforceable cut-off dates before that. They did not seem prepared to recognise the
