Approach being developed

Taking the foregoing considerations into account, one

approach would be to accept that those Hong Kong

NPC/CPPCC members who are registrable and, at the next

updating of the General Electoral Roll, have registered as

electors under Hong Kong law should form an electoral college

in the 4th sector of the EC to elect a number of EC members.

Critical to the political acceptability in Hong Kong of

such an approach would be the split of the 150 EC seats

(in the 4th sector) to be allocated to the NPC/CPPCC electoral

college. The note at Annex sets out a number of scenarios

none of

them appears to be particularly attractive, and all

except scenario (6) - would attract very severe criticism of

a "sham" election.

As regards Legco

have initially argued that

as

members, although the Chinese

they should have seats on the EC

as of right, they have not put as much emphasis on this

they had on the role of NPC/CPPCC members. Furthermore,

it is hard to imagine that they would really insist on giving

EC seats to those Legco members (e.g. Martin Lee, etc.) who

are anathema to the Chinese. We should therefore not propose to the Chinese that we would accept Legco members as of right

in the 4th sector. Nevertheless, if the Chinese were

to

insist on their inclusion, we could consider accepting that 60 Legco members, together with the members of the DBS, the Municipal Councils and the Rural FC should form a separate

electoral college to elect the balance of the EC members

in the 4th sector.
