AS you will see, the potential problems are getting complicated the more we look into them. Clearly we will need to give more detailed thoughts to these problems at a later stage; equally clearly, it would be desirable to be able to come up with remedies το these problems. That said, I think we should not lose sight of the fact that we would not want implement any nationality restriction before 1997 for reasons which we are all aware. Indeed, even the possible remedies envisaged in paragraph 7 of the note are very likely to be non-starters because of incompatibility with the ICCPR.

The complications do, however, lend greater support for probing the Chinese further at some suitable opportunities on how they intend to implement the nationality restrictions post-1997, without compromising our position that we would not implement them in 1995.
