BUUNDAKY AND ELECTION COMMISSION BILL

The consequential and other amendments contained in Schedule 2—

(a) to the Legislative Council (Electoral Provisions) Ordinance (Cap. 381) and the Electoral Provisions Ordinance (Cap. 367) and subsidiary legislation under those Ordinances--

(i) require the Governor in Council in declaring geographical constituencies for the purposes of an ordinary election to have regard to the recommendations made by the Commission as regards the delineation of such

constituencies;

(ii) confer on the Commission the power to appoint returning

officers under those Ordinances;

(iii) empower the Governor to postpone an election or a poll or adjourn an entire poll or a count where he considers that the election, poll or count is likely to be affected by riot or open violence;

(iv) empower the Governor in Council to make regulations relating to the amount of or disposal of any election deposit, subscribers for a nomination paper, particulars relating to the system of voting and counting in any election held under those Ordinances and the determination of an election result;

(v) enable the Commission to request from the court a report on

any matter relating to an election petition; and

(vi) make technical amendments consequent upon the transfer of the power to make regulations on electoral matters to the Commission;

(6) to the Urban Council Ordinance (Cap. 101) and the Regional Council Ordinance (Cap. 385) provide for the declaration of the Urban Council area and the Regional Council area respectively under those Ordinances and require the Governor in Council in making those declarations to have regard to recommendations made by the Commission in relation to the demarcation of constituency boundaries;

(c) to the District Boards Ordinance (Cap. 366) provide that the total number of elected members of all the District Boards shall not be substantially greater or less than 338 and that----

(i) the Governor in Council may declare the number of Districts proposed to be declared under section 3(1) of that Ordinance and assign a name to each such proposed District;

(ii) in declaring District boundaries, the Governor in Council must have regard to the recommendations made by the Commission in relation to the delineation of constituencies for elections to the District Boards; and

3. 附表2所載的相應及其他修訂——

(a) 就《立法局(選舉規定)條例》(第381章)及《選舉規定條例》(第367章),以

及根據該等條例訂立的附屬法例而言——

(i)要求總督會同行政局就普通選舉宣布地方選區時,須顧及委員會就

該等選區的劃定作出的建議;

(ii) 授權委員會根據該等條例委任選舉主任;

(iii)授權總督在認為某次選舉、投票或點相當可能受騷亂或公開暴力 所影響的情況下,將該選舉或投票延期,或將整個投票或點票程序 押後;

(iv) 授權總督會同行政局就任何選舉按金的數額或處置、提名書的簽署 人、根據該等條例舉行的任何選舉的投票及點票制度的有關詳情及 選舉結果的決定等事項訂立規例;

(v) 賦撒委員會向法庭要求提供一份與選舉呈請有關的任何事項的報

街;及

(vi)對就選舉事項訂立規例的權力轉移予委員會一事,相應地作出技術

上的修訂;

(5) 就(市政局條例》(第101章)及《區域市政局條例》(第385章)而言,就分別 根據該兩條例宣布市政局轄區及區域市政局轄區事宜訂定條文,並要求 總會同行政局在作出上述宣布時,顧及委員會就選區分界的劃定作出 的建議:

(c) 就《紧讖會條例》(第366章)而言,規定所有區議會的民選議員的總數,

不得大幅高於或低於338名,而——

(i)總督會同行政局可宣布其提議根據該條例第3(1)條宜布的地區的數

日,並為上述各建議地區指定名稱;

(ii) 在宜布地區的分界時,總督會同行政局須顧及委員會就區議會選舉

的選區劃定而作出的建議;及
