Amendment
(s) In regulation 46A(5) repeal "Governor" and substitute
"Boundary and Election Commission”.
(1) Add-
"46C. Procedure for adjournment by
Governor of count at the
counting stations
(1) An adjournment of counting of the votes at counting stations under section 26A(1) of the Ordinance shall be by a notice by the Governor published in the Gazette or if such publication is not practicable in the circumstances, by the publication of a notice by him (substituted notice) by some other
means,
(2) The appointment of a date for the counting of voles for the purposes of section 26A(2) of the Ordinance shall be made either in the notice or substituted notice adjourning such counting and referred to in subregulation (1) or in some other notice by the Governor published in the Gazette as soon as practicable thereafter, or if such latter notice is not practicable in the circumstances, by the publication of a notice by him by some other means.
(3) Where the counting at the counting stations is adjourned pursuant to a declaration" by the Governor under section 26A(1) of the Ordinance, regulation 46A(4), (5) and (6) shall apply in respect of such adjournment as it applies in respect of an adjournment under regulation 46A(1).”.
(u) In regulation 50(3)(h) add "and to the Boundary and
Election Commission" after "Chief Secretary”.
(a) In rule 6(3)(a) add “and to the Boundary and Election
Commission" after "Legislative Council Chamber”.
(b) In rule 11(4)(d) add “and to the Boundary and Election
Commission" after “Chief Secretary”.
(c) In rule 14(2)(a) repeal "and the Chief Secretary" and substitute", the Chief Secretary and the Boundary and Election Commission".
(d) In rule 16(2) repeal "and the Chief Secretary" and substitute ". The Chief Secretary and the Boundary and Election Commission”.
(e) In rule 20(3)- --
(i) repeal “and the Chief Secretary" and substitute ", the Chief Secretary and the Boundary and Election Commission";
(ii) add "or Commission” after “person”.
(a) In regulation 26(2)(s) repeal "Secretary for Constitutional
Affairs" and substitute "Boundary
Commission".
(b) In regulation 36A(1)—
and Election
(i) repeal "Governor" and substitute "Boundary and
Election Commission";
(ii) repeal “he” and substitute "it".
