BOUNDARY AND ELECTION COMMISSION BILL

“Chief Electoral Officer" (總選舉事務主任) means the Chief Electoral Officer

appointed under section 9;

“Commission”(委員會) means the Boundary and Election Commission

established under section 3;

“District”(地區) has the meaning assigned to it in the District Boards

Ordinance (Cap. 366);

“District Board"(區議會)means a District Board established under section S of

the District Boards Ordinance (Cap. 366);

“clection”(選舉) means, except in Part V and section 8, an election within the meaning of the Legislative Council (Electoral Provisions) Ordinance (Cap. 381) or the Electoral Provisions Ordinance (Cap. 367);

“function”(職能 ), except in section 4, includes a power or a duty;

"member" (委員) means a member appointed under section 3 or section 1 of

Schedule 1.

Establishment and membership

(1) There is hereby established a body corporate to be known as the Boundary and Election Commission which may sue and be sued in that name.

(2) The Commission shall consist of 3 members appointed by the Governor in accordance with this section.

(3) Of the 3 members appointed under subsection (2)-

(a) one shall be a person nominated under subsection (4); and (6) one shall be a judge of the High Court..

(4) The President of the Legislative Council shall nominate a person for the purposes of subsection (3)(a).

(5) A person shall not be appointed under subsection (2) or hold office as a member if he-

(a) is not an elector within the meaning of the Electoral Provisions

Ordinance (Cap. 367);

(6) is or becomes-

(i) a member of the Executive Council or an appointed member

of the Legislative Council;

(ii) an elected Member within the meaning of the Legislative Council (Electoral Provisions) Ordinance (Cap. 381), or a member within the meaning of the Electoral Provisions

3. 委員會的設立及其成員

(1)現設立一個名為選區分界及選舉事務委員會的法團,該法團可以該名義起訴 及被起訴。

(2) 委員會由總督按照本條委任的3名委員組成。

(3) 根據第(2)款獲委任的3名委員當中—————

(5) 任何人如有以下情況,均不得擔任委員或根據第(2)款獲委任為委員-

(a) 他並非《選舉規定條例》(第367章)意指的選民;

(b) 他是或成為

(i) 行政局議員或立法局委任議員;

(ii) 《立法局(選舉規定)條例》(第381章)意指的民選議員,或《選舉規定 條例》(第367章)、《市政局條例》(第101章)、《區域市政局條例》(第 385章)或《區議會條例》(第366章)意指的議員;或
