In the unlikely event that the courts did not accept this view, our Legal Advisers see force in the additional argument that Article 25(b) of the ICCPR gives gives citizens a right and opportunity
to vote in elections on the basis of universal equal suffrage. To require citizens to make a choice as to what kind of vote they wish to cast (where one or more of those kinds of votes could arguably not be on the basis of universal and equal suffrage) would not be to deny citizens the right and opportunity to vote on the basis of universal and equal suffrage.
