With reference to your manuscript minute of 27 January about the Secretary of State's approval being required for a wider range of senior jobs in the Hong Kong Administration, I thought it would be helpful if I set down the various appointments for which the Secretary of State's approval is required and the level at which they should be approved.
2. The Secretary of State's letter to the Governor dated 3 June 1991 (copy attached) set out the posts for which his approval for appointments or promotions is still needed. Paragraph 3 of Mr Stone's minute of 10 February, set out the existing internal practice for referring appointments to the Secretary of State. On the basis of your manuscript minute however, I now recommend that:-
(i) the Secretary of State himself should personally approve the appointment and promotion to the posts of:
Chief Secretary
Financial Secretary Attorney General
Commissioner of ICAC Commissioner of Police
Chief Justice
Secretary for Security
(ii) the Head of HKD should convey the Secretary of State's approval for the appointment and promotion to the posts of:
Secretaries of policy and resource branches
All Law Officers
Director of Audit
Director of Immigration
High Court Judges
Commissioner of Customs and Excise
3. Any controversial/sensitive appointments falling under category 2 (ii) could also be referred to the Secretary of State/Minister/AUS when necessary.
4. I would be grateful for your approval that we should proceed on this basis for all future appointments.
