MEMORANDUM FOR EXECUTIVE COUNCIL

APPLICATION OF THE 1988 UNITED NATIONS CONVENTION AGAINST ILLICIT TRAFFIC IN NARCOTIC DRUGS AND PSYCHOTROPIC SUBSTANCES TO HONG KONG

THE PROBLEM

We need to consider whether the 1988 United Nations Convention Against Illicit Traffic in Narcotic Drugs and Psychotropic Substances (the 1988 UN Convention) should be applied to Hong Kong.

RECOMMENDATION AND ADVICE SOUGHT

It is recommended that we should seek the application of the 1988 UN Convention (at the Annex) to Hong Kong.

Members will be asked to advise whether this recommendation should be approved.

BACKGROUND AND ARGUMENT Background

The United Nations adopted the Convention Against Illicit Traffic in Narcotic Drugs and Psychotropic Substances on 19 December 1988. The 1988 UN Convention, also referred to as the Vienna Convention, entered into force on 11 November 1990 after the required number of States had ratified it.

The Convention promotes international cooperation to address the various aspects of illicit drug trafficking. Article 3 requires Parties to establish criminal offences relating to the illicit manufacture, possession,
