Vacancy for Justice of Appeal

I attach a notification of the above vacancy and recommend, on the advice of the Judicial Service Commission, that Mr. Justice John Barry Mortimer, at present a Judge of the High Court, be appointed a Justice of Appeal.

In my letter to you dated 7 January 1993 I wrote about the three vacancies in the Court of Appeal and the Judicial Service Commission's recommendation on filling two of them. Following the Secretary of State's approval, Mr. Justice Bokhary has now been appointed a Justice of Appeal. We do not yet seek approval for Mr. Denis Chang's appointment, as it is still pending his decision and his release from the membership of ExCo, if and when the Governor is prepared to release him.

The Judicial Service Commission considered the question of filling the third vacancy at its meeting on 6 March 1993. After detailed discussion, in which a number of Judges of the High Court were carefully compared in respect of their intellect, judicial temperament and personal conduct, Members unanimously resolved to recommend the appointment of Mr. Justice Mortimer to the Court of Appeal. The relevant minutes of the meeting are at Enclosure 1 and a short note on Mr. Justice Mortimer is at Enclosure 2.

The Governor has accepted the recommendation of the Judicial Service Commission and has directed that the appointment of Mr. Justice Mortimer as a Justice of Appeal be recommended to the Secretary of State for approval.
