HMOCS: HOME CIVIL SERVICE: SECURITY VETTING AND RESIDENCE

You wrote to me on 9 November last about this vexed question and I regret it has taken me so long to reply, in part due to our change of location. My Deputy, Tony Hardwell, has spoken to you about this matter and I understand that you are endeavouring to identify the person in MOD with whom Peter Ricketts corresponded last year. We have been unable to identify the source of the advice which you say was given by MOD i.e. members/dependents of members of the Royal Hong Kong Police Force (RHKPF) are eligible for a waiver of the 5 year residence rule for employment in vettable posts on the grounds that they are "resident outside the UK because of his or her parent's UK Government Service". There may be some confusion with the Nationality Rules, which is a separate matter.

My understanding is that consideration should be given to a waiver of the rule in circumstances where the Crown Servant is

not permanently resident in the overseas country and/or satisfactory security liaison with that country exists and appropriate criminal and security records may be accessed by our security liaison officer.

The position in Hong Kong is complicated by the fact that members of the RHKPF, although they may

be deemed to be "Crown Servants", are not necessarily UK based,

nor necessarily of UK origin and are most likely to be permanently domiciled in the colony. After 1997 it is unlikely that we will be able to rely on the validity of record checks even in the event that some form of security liaison established.
