Paragraph 10(3) I am not certain that this sub-paragraph entirely meets the bill. I attach three diagrams which show how the scheme will operate. Diagram 1 shows the position of an officer who is subject to the CAP. Diagram 2 showS the position where the compensation calculated under the Scheme is always less than the CAP. In Diagram 3 we have a combination of both. In all three cases the compensation falls away during the drawdown period and the amounts payable are frozen at the highest level. I hope this is clear. We can discuss when we next meet.

Paragraph 11 - The provisions of paragraphs 10(2), (3) and (5) will apply to the calculation and payment of compensation to superseded officers. I will FAX two examples tomorrow.

QUESTION You will want to consider whether the

compensation for superseded officers should be calculated using the salary of the next grade: as the Scheme stands, we may not be treating such officers fairly as the very fact they are superseded puts them at a disadvantage to their colleagues who will have benefitted from promotion and, consequently, a higher salary. Comments?

Paragraph 12

Like paragraph 11 we need to ensure that the provisions of paragraph 12 are properly linked to paragraph 10.

I take it that the Scheme only allows paragraph 12 to be applied to officers who transfer on or after 29 June 1997?

3. I should be able to attend a meeting with you and Paul any time after 30 November in order to finalise the Scheme. I will the also make myself available to push things through with Treasury should the need arise.

4. In the meantime I think you should prepare an outline to both the Compensation and Sterling Safeguard Schemes now. I doubt very much if you will make 6 December dealine for submission to the HMOCS Association.
