DRAFT COMPENSATION SCHEME
1. Thank you for sending me a copy of Mike Waters' (10th June) and Alan McDonald's (23rd June) comments on the revised draft attached to my fax of 3rd June. In this fax I deal only with those comments which would not be affected by a decision to change the Scheme from an instalment scheme to a lump sum scheme.
Title: Omit "RETIREMENT AND”.
Definition of pensionable service (MW): I do not think we need mention the irrevocable decision. Paragraph 9(3) would exclude a period of service prior to the appointed day unless on that day it counted as pensionable service and, as I understand it, past contract service would not count as pensionable service on that day unless the gratuity had in fact then been repaid.
Definition of review orders (AM): Replace by reference to orders under section 59 of the Social Security Pensions Acxt 1975.
Paragraphs 3 and 4 (AM): McDonald is correct. Except for advancing the appointed day in certain cases, these paragraphs do not affect the compensation provisions.
