PAUL FIFOOT
SCHEDULE
0372723755
P.02/05
Part I: The definitions to the main part of the Scheme apply to the Schedule as well. See the definition of Government of Hong Kong in paragraph 2.
Part II A: See comment on Part I above.
(a): Are there not different salary points for (some) grades? If so, will you not need to determine the salary point at retirement of the relevant grade to determine its equivalent in 1992 ? "allowances" is included because it forms part of the definition of "pensionable emoluments" in the relevant pensions laws.
(a): Here we are calculating the sterling value of a pension. Is a part of a month relevant to the calculation or is it relevant to payments ? If the latter, the amendment needs to be made in paragraph 5 of the main part of the Scheme rather than here. In which case, add at the end of paragrapli 5:
"Where a pension is payable in respect of only a part of a month, the notional Hong Kong pension shall be calculated on the same basis, and any supplementary payment shall be the difference between the two.
Part II B: See comments on Part I and Part II A(g) above.
Part II C:
(c): If we are to include a reference to sections 1 and 2 of the 1971 Act here, should we not do so also in Heads A, B and C (and, subject what is said below, in Head F) ? Pensions under those Heads may also date from before 1975. If Head C is the only place where such a reference is required, Alan McDonald may wish to consider the following:
"(c) increase the sum obtained at paragraph (b) as if that sum were a pension begining on the same date as that used to determine the entitlement of the officer
