RULES FOR CALCULATING AND DETERMINING
A NOTIONAL HONG KONG GRATUITY AND ITS STERLING VALUE
G: Members of HMOCS ("officers") who retire from the service of the Government of Hong Kong and elect to commute
part of their Hong Kong pension for a gratuity
To calculate the sterling value of an officer's notional Hong Kong gratuity:
(a) Calculate the officer's notional Hong Kong pensionable emoluments in accordance with Head A (a) and (b);
(b) (I) Unless the officer also has service under a Scheduled Government, apply the provisions of the relevant law as in force on 1st January 1992 to the notional Hong Kong pensionable emoluments to calculate the gratuity in accordance with the option exercised by the officer as if they were the pensionable emoluments to be taken for the purpose under the relevant law;
(II) If the officer also has service under a Scheduled Government, apply the mixed service formula to the notional Hong Kong pensionable emoluments to determine the pension that would be payable on those emoluments in respect of the officer's Hong Kong service, and then apply the provisions of the relevant law to that pension to calculate the gratuity in accordance with the option exercised by the officer;
(c) Divide the sum obtained at paragraph (b)(I) or (b) (II), as appropriate, by XX; the resulting sum will be denominated in pounds sterling;
