In the case of an officer who died in service, determine the unreduced basic pension which would have been granted under the relevant law if he had retired on the date of his death;

(b) Identify the basic pension granted to the dependant in accordance with the relevant law;

(c) Calculate the officer's notional Hong Kong pension in accordance with whichever of Heads A,B,C,D or E is appropriate, save that:

(i) where the officer commuted a part of his own pension or the pension was reduced by any authority, the commutation or reduction will be ignored and the notional Hong Kong pension will be calculated as if the officer had been in receipt of an unreduced pension;

(ii) in increasing any sum as provided in those Heads, the date of the officer's death will be substituted for the date on which a calculation is to be made to determine whether a supplementary payment is payable.

Where the officer died in service, the calculation of the notional Hong Kong pension will be made on the basis of an unreduced basic pension which could. have been awarded under the relevant law if he had retired on the date of his death.
