5 Entitled officers: Should we keep "overseas" ? It is useful here as indicating in broad terms the kind of officer we intend to benefit, but if we use it in the stat scheme wo may have to define it and such a definition would be little more than a repetition of part of the definition of HMOCS. Let us keep it for the time being and think further.

I have added to the requirements here a requirement that the individual was on the pensionable establishment on 1st May 1993 to tie in with our amendment of the Speciai Regulations, particularly as this part of the requirement applies also to judges, see below.

$6 Judges: As agreed, I have omitted the reference to.. HMOJ becausc: i) there are no regulations for IIMOJ (it was originally just a list and I do not know whether tnať list has been kept up); ii) overseas judges in Hong Kong may still be admitted to the pensionable establishment and they may claim, not without some justification in an non- technical sense, that they are Her Majesty's overseas judges and, therefore, part of HMOJ. I hope the passage starting "have been individually informed" will cover all the people who are entitled to be included, but we will need to watch the point when the draft is discussed with Hong Kong.

§ 8 Non-entitled officers: Are there any judges who are seconded or temporarily transferred to Hong Kong ? I have assumed not. As I read the Limited long Kong Scheme, it does not apply to judges. Is this agreed-?

9 Calculation Tables and maximum sum: For (3), see also the definition "pensionable service". For (4), the RPI is added in calculating the maximum sum for all entitled
