You suggested that if we had any comments on the paper attached to Peter Owen's letter to me of 5 May, it would be best to provide them in writing before the meeting on 10 May.
We think the paper presents a good summary of the issue and a fair reflection of the FCO position. The following points are mainly for clarification:
Para 1: Of the 700 officers in HMOCs, around 380 are in the Police, 100 are Administrative Officers, 60 are in the Judiciary, and the rest are from various grades eg
accountants, engineers, surveyors etc. The number of HMOCS pensioners is 1,600.
Para 3: Although judicial review is covered separately later in the paper it might also merit a reference here.
Para 4: The exclusion of Hong Kong in the 1960 White Paper was related to the support in the aid programme for the continued employment of expat personnel and not for the sort of issues now under discussion. Officers in other territories which were excluded and have since moved to independence have benefited from the same compensation and pension safeguard arrangements as were provided for officers in territories which were not excluded. I would suggest deleting the
sentence.
Para 5: The HKG schemes are compensation schemes rather than protection schemes.
Para 6: I think I gave you slightly misleading advice on our proposal. In fact we propose that, as in previous cases, officers benefiting (including those staying on) would receive compensation in instalments with 5% annual interest on outstanding balances. You you may wish to recast the penultimate sentence accordingly.
