Overseas officers appointed on agreement terms who transferred to pensionable terms before 26 July 1991 may buy back pensionable service at any time up to retirement. Judicial officers, on the permanent establishment, who were aged

or above on 30 August 1991, were permitted to retain the right to refund contract gratuities by means of one lump sum payment

later than 10 days before they

commenced pre-retirement leave.

HMG has decided that :

Judicial officers referred to in paragraph above will be required to sign an irrevocable undertaking before or on 30 April 1993, to buy back such contract service as they wish to convert to pensionable service to count as pensionable service under any HMG compensation scheme for HMOCS officers.

(iii) officers in (i) and (ii) above must have completed buying back such contract service as they wish to count as pensionable service for the purposes of any HMG compensation scheme before the appointed day for the compensation scheme.

It is emphasised that

any

these deadlines are

relevant only to

compensation scheme which HMG may promulgate for members of HMOCS. The arrangements have no bearing on HKG'S policy on buying back of service for the purpose of enhancing pension entitlements under Hong Kong pensions laws.
