HONG KONG: HMOCS ARRANGEMENTS

Thank you for your letter of 3 February.

The two White Papers which set out the terms and

conditions for HMOCS officers leave us with real obligations. In all 42 HMOCS territories, HMG have made arrangements to

provide these officers with full compensation and full pension protection. This has been done without exception. That is the standard against which our proposals will be judged, in

the House and if HMOCS officers take us to judicial review

in the Courts.

You propose in effect that we should treat Hong Kong HMOCS

Lin orner Terrilcries officers worse than their predecessors (because of the current public expenditure climate in the UK and because they receive salaries and pension benefits which are better than their UK

counterparts.

But:

- there is no precedent for taking into account UK salary and pension levels in determining arrangements for HMOCS. This is in spite of the fact that pension earning rates for colonial civil servants have always been better than their UK counterparts, and we have never sought to penalise those in the colonies whose salaries

were also higher.
