average during that [year] [period] of the exchange rate and the rate of HK$ XX = £1 multiplied by a figure equal to the UKPB.
(2) If the amount of a pension granted and payable under the law of Hong Kong is greater than the notional Hong Kong pension,
then, in making any calculation under this section, the amount of
any increase made under the law of Hong Kong since the grant of
the pension [and the amount of any supplement made under SPOS] to
be attributed to the notional Hong Kong pension shall be in the
like proportion as the notional Hong Kong pension bears to the
total pension granted under the law of Hong Kong.
(3) No supplement shall be payable under this paragraph in
respect of [any year or period] unless the pensioner has transferred the equivalent of the sum paid to him during that
[year or period] as his pension into [sterling or some other
currency designated by the Secretary of State] [a currency other
than a currency of any part of the People's Republic of China].
5.
Registration of UKPB
(1) In order to qualify for the payment of supplements under this Scheme, a pensioner shall provide the Secretary of State:
(a) with such information as will enable him to calculate and
register that pensioner's UKPB:
(i) in the case of a pension granted before the publication
of this Scheme, within six months of such publication;
(ii) in the case of a pension granted after the publication
of this Scheme, within three months of the grant of such
pension,
or within such longer period as the Secretary of State may permit;
(b) with such other information, within such period as the
Secretary of State may require, as will enable the Secretary of
