(C) In the case of a pension granted to a dependant of a member of HMOCS who retired or died during his service after the publication of the Scheme

i) identify the salary point and allowances for the substantive grade of the relevant deceased contributor (or relevant member of HMOCS) which would, apart from this provision, be taken into account as the pensionable emoluments of such contributor or member in calculating the dependant's pension and determine the salary and allowances appropriate to that salary point of that grade on 1st January 1992. Calculate the pensionable emoluments and the dependant's pension by substituting the salary and allowances as at 1st January 1992 for any higher salary attributable to the contributor or member. The amount so obtained in respect of the dependant's pension is the dependant's notional Hong Kong pension;

ii) convert the amount of the NHKP into sterling at the average rate of exchange for 1991 (HK$ 13.76 =£ 1). The amount so obtained as increased by the increase in the UK retail price index during the period from 1st January 1992 until the date of the grant of the pension to the dependant is the dependant pensioner's UKPB.

(D) In the case of a pension granted to the dependant of a member of HMOCS who retired or died during his service before the publication of the Scheme

i) The amount of the pension granted under the law of Hong Kong is the notional Hong Kong pension;

ii) convert the amount of the notional Hong Kong pension into sterling at [the rate of exchange in force on the date on which the Hong Kong pension was granted][the average rate of exchange for 1991 (HK$ 13.76 = £ 1)]. The amount so obtained is the dependant pensioner's UKPB.
