1 We have reconsidered the advice in our telno 500. The US list submitted to the Sanctions Committee, although it coincides with our own views on Serbian ownership, does not have sufficient Legal status on which to justify impounding. We are considering our certification procedure to implement the impounding provisions in the UK and will keep you informed. No certificates have yet been issued. In the meantime you should rely on registration documents as evidence of ownership. If there were a means to refuse the supply of any services to vessels on the US List, even with insufficient grounds to impound, this would be desirable.
2. The definition of harbours is in the Harbours Act 1964, quote Harbour except where used with reference to a Local Lighthouse authority, means any harbour, whether natural or artificial, and any port, haven, estuary, tidal or other river or inland waterway Scotland a
boatslip being a marine work, and, where used with reference to such an authority, has the meaning assigned to it by Section 742 of the Merchant Shipping Act 1984 unquote. Given the ambiguity in SCR 820, it should not be necessary to impound subject vessels in transit through Hong Kong territorial waters, only those that enter port.
