INTRODUCTION

PART IV

THE COURTS DURING AN EMERGENCY

It will be the responsibility of the Chief Justice, through the Registrar of the Supreme Court, to maintain the courts during times of civil

disturbance.

GENERAL METHOD

2.

The Courts will continue to administer the law prevailing at the time, including any Emergency Legislation in force.

3.

As soon as Gazette Notices proclaiming the introduction of Emergency Legislations have been printed, the Government Printer will deliver 100 copies of the Gazette to the Registrar, Supreme Court.

4.

In any serious emergency, curfew control will make it impossible for the courts to continue normal business.

Other considerations aside, witnesses will not be available, even though only certain districts are under curfew. Generally, therefore, Courts will probably wish to adjourn all cases during the hours of curfews, other than those dealt with in paragraphs 6 to 8.
