The Public Service Commission was briefed on the subject at its meeting on 7 May 1993. Members were generally in favour of permitting overseas officers who have lived here for more than seven years to transfer to local terms subject to some conditions.

This subject has been in the public domain for some time and has attracted moderate media attention. Media coverage has focused on the BOR angle, the possible legal action by the AECS, reactions by local civil servants and comments by a local judge on the AECS claims. We expect a mixed reaction to the policy change. Those who share the views of the AECS, for example some human rights groups, would welcome the decision. It would also be supported by those in the community, particularly the business community, who consider it reasonable to permit overseas officers who have lived here for more than seven years to continue serving in the civil service. On the other hand, those who support the SNEOA, for example press commentators who see overseas officers as having an unfair advantage over local officers in conditions of service, would criticise the decision. Others would be concerned about the implications on the pace of localisation. Views in Legislative Council can also be expected to be divided.

After informing the Chinese side of the policy change, a Legislative Council Brief and a press release will be issued. We expect this to be done within a week of the decision of this Council. The Legislative Council Panel on Public Service will be informed of the changes at its scheduled meeting with the Administration on 30 July 1993. Background briefings for the media will be organised if necessary. A spokesman will handle enquiries.
